User Agreement

PLEASE MAKE SURE THAT YOU READ CAREFULLY, THE USER AGREEMENT BEFORE MAKING USE OF ANY OF THE SERVICES ON THE SITE.

IF THE USER DOES NOT ABIDE BY THE USER AGREEMENT/THE TERMS AND CONDITIONS, HE OR SHE SHALL NOT ACCESS THE SITE.

1. Terms and Acceptance

This user agreement (this “Agreement”) sets forth the legally binding terms and conditions your access to and use of any websites, mobile sites, mobile applications, desktop applications, products or services (the “Services”) offered by www.travellingwheel.com (to the extent further described below) (“travellingwheel”, “us”, “our”, and “we”). The “User”, “you”, “your” shall refer to any natural person or entity and its authorized users that subscribes or uses the Services. Certain features of the Site may be subject to additional guidelines, terms, or rules, which will be posted on the Site in connection with such features. All such additional terms, guidelines, and rules are incorporated by reference into this Agreement.

 By accessing or using the services, you are accepting this agreement (on behalf of yourself or the entity that you represent), and you represent and warrant that you have the right, authority, and capacity to enter into this agreement (on behalf of yourself or the entity that you represent). You may not access or use the services or accept this agreement if you are not at least 18 years old. If you do not agree with all of the provisions of this agreement, do not access and/or use the site. These terms require the use of arbitration (section 13.1) on an individual basis to resolve disputes, rather than jury trials or class actions, and also limit the remedies available to you in the event of a dispute.

 We may amend this Agreement related to the Services from time to time. Amendments will be effective upon our posting of such updated Agreement at this location or the amended policies or supplemental terms on the applicable Service. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Agreement, as amended.

1.1 Travellingwheel.com (“Travelling Wheel”), a company incorporated under the laws of India, with its principal office in Faridabad renders wide range of travel related services through its site (www.travellingwheel.com).

1.2 Travelling Wheel would provide the customers with every information related to travel, price, reservations and availability for , holiday packages, airlines, and hotels across the regions around India. The above mentioned services can be utilized by the users across India 24/7 as per the availability of various third party service providers like airlines, hotels, tour package providers etc.

1.3 This Master Agreement applies to all Travelling Wheel Services. Additionally, based on the services selected by the user, the respective user need to read and abide by the terms and conditions for each service that might be modified or updated by Travelling Wheel in frequent times. The Terms and Conditions are deemed to have a part in this Agreement and in case of any conflict between the Terms and Conditions and this Agreement, the terms of this Agreement shall stand.

1.4 Travelling Wheel services are provided to the user based on conditions and their acceptance without frequent modification of any information displayed on the website. For any clarifications, it is stated that when a user avails any of the services, it is completely by the user’s acknowledgement and acceptance of this agreement. Any user who does not accept these terms and conditions shall not make use of the services.

1.5 In addition to this, the third-party service providers like hotels, flight booking, bus booking etc., might have a different set of terms and conditions. You might want to read their respective terms and conditions before using their services. It directly means that if you use their services, you also abide by their policies.

1.6 Travelling Wheel shall not provide any service until full amount is paid by the user. There are other modes of service too, but service without any mode of payment will not be encouraged by the website.

2. Business

2.1 Travelling Wheel acts as a bridge between the travel package providing Vendors and the users who make purchases on the site. Any service provided by the vendor would be delivered to the user through the site and the facilitation that renders communication is what the site is limited to and cannot be held responsible for anything else.

2.2. Travelling Wheel acts as a router to transmit the payments from the user to the vendors. The site cannot be held responsible for payments that have not been received in our end.

3. Privacy Policy

The user hereby accepts, agrees and confirms that he/she has read and understands the Privacy Policy of Travelling Wheel completely. The User further provides consent that the terms and conditions and the respective Privacy Policy are acceptable to them.

4. Modification in Terms and Conditions

Travelling Wheel has the right to alter the terms & conditions and privacy policy based on the services offered via the site. The user is solely responsible for checking and viewing these terms and conditions in regular intervals before using the services.

5. Any Usage against the law is prohibited

When the user starts using Travelling Wheel, they must not perform any unlawful activities using the site. If so, they will be punished as per the law and order of the respective country’s rules and regulations. Travelling Wheel does not encourage any unlawful activities and will not perform any activity that stands against the law and order.

6. Links to Third Party Sites

6.1 Travelling Wheel site might comprise of third party links in their pages. Those third party sites might be linked due to advertisement or other service related purposes. Any impact caused due to those sites are not interlinked with Travelling Wheel. Before the user connects to those sites, they have to read their terms and conditions for better clarity.

6.2 Travelling Wheel will not take responsibility for any error, miscommunication or wrong information in the linked sites. It is completely at the disposal of the user to check their policies before using any of their services.

7. Use of Communication Services

In open platforms for communication such as chat, comments, reviews, etc., the user must not defame, harass, and humiliate any service or people as it is a public forum. The user must abide by the rules and regulations when they record their opinion.

8. Restriction or Termination of Access

Travelling Wheel can terminate or restrict the access of your usage of the site without any notice at all times in case of any inappropriate usage by the user. The site or its authorities will not be answerable for the same.

9. Payment Options

The payment methods listed below shall be incorporated in Travelling Wheel:

9.1. Online Card Payments including Master Cards,and Visa cards can be used for transaction through our certified online gateways which operates under 128 bit encryption technology. The payments methods are designed in such a way that user’s information are protected under SSL encryption updated to the latest technology. The site is known for Verisign certification thus ensuring safe and secure transactions.

9.2. For Internet Banking options, the user can make payments if their account falls under the list of banks. Once the transaction is being carried out, the amount would be deducted directly from the user’s account. Travelling Wheel makes use of third-party payment gateways to process the transactions.

9.3. Gateway Charges: Travelling Wheel is not liable for any transaction fees charged by the banks or the third-party payment gateways. The site cannot be held responsible for these deductions.

10. Confirmation of Transaction

10.1. The user must not react upon transaction failures unless and until an email confirmation is received from Travelling Wheel official email address. The user must wait for a stipulated amount of time to receive the confirmation email. After complete checking of Junk/Span folders, the user can get in touch with the Travelling Wheel customer care center to get their issues resolved.

10.2. While booking a trip or travel tickets, the total amount to be paid will be displayed before redirecting to the transaction site. If the Vendor, for e.g., the hotel booking or flight booking provider rejects the order, the user will be intimated through an email at the earliest.

11. Cancellation Policy

11.1. In case of any amendment or cancellation from the Vendor end, it will be routed to the user through Travelling Wheel by email or any other mode of communication.

11.2. On cancellation of booking, the user might receive an email intimating the same. The amount transacted during the booking will be reverted back to the user’s account within a reasonable period of time as per commercial site policy. Additional listings comprising of other alternatives to select from will also be sent to the user via mail.

11.3. In case the user is interested in choosing an alternate listing provided by the vendor, the user can pay the differential amount to the Travelling Wheel or deduct the existing refund amount and shall wait for remaining amount to revert back into their account.

12. Refund Policy

12.1. Wherein, if the user does not show up for the booking or utilize the service, refund cannot be claimed. A refund can be processed only 90 days prior to the travel date/ check-in date. Any time later, their request for refund would be declined and shall not receive any refund.

12.2. If the user applies for the refund with in 90 days from  the flight date/trip date/check-in date, it will be processed within 15 – 20 days of their request once the vendor reverses the payment to Travelling Wheel. In case of a credit card payment, the amount will be reversed back to the credit card itself and bank deposits will not be encouraged in this case.

12.3. If the user makes an order directly with the Vendor, Travelling Wheel shall not be liable for any discrepancies happening henceforth. In case of any fraudulent activities, Travelling Wheel cannot be held responsible. The user and the Vendor will be solely accountable for their individual transactions.

12.4. The user must read and understand the cancellation and refund policies of Travelling Wheel and Vendor before booking flights, hotels and tour packages. If it is not acceptable by the user, then he/she shall not make a booking in Travelling Wheel site. 

13. Pricing Charges Information

13.1. Travelling Wheel does not charge any separate fee for browsing the services on the site. The site might provide free membership for accessing all the services but transactional charges may apply.

13.2. User is expected to make payments as per the rules of Government of India without involving any illegal mode of transactions.

13.3. Travelling Wheel aims at providing the lowest prices for all its services but there is no guarantee that the prices listed are the lowest in the market.

13.4. Travelling Wheel will thrive to establish quality services in terms of pricing information and content perfection. Occurrence of any oversight in terms of typographical errors will be fixed if a purchase was made wrongly by the user. The order would be cancelled and the user will be asked to repeat the purchase once the error is fixed.

13.5. If an order was cancelled, the user will receive the paid amount to their respective account once the cancellation is processed. It may  take few days depending  on the mode of payment.

14. Fees Payment

Travelling Wheel is provided with the rights to charge various fees including duties, taxes, if any for listing the services and also the transaction charges on usage of the site. Travelling wheel also has the right to alter the fees from time to time without any prior notice. The user who accesses the site and its services will be liable to pay the same in order to continue using the services.

15. Promotion Codes

15.1. Travelling Wheel may offer you with variety of discount coupons which you can avail on the website based on travel seasonality.

15.2. For any of the active promotional discounts available in the website, Travelling Wheel reserves all rights to modify the usage terms for these discounts or withdraw them completely without sending prior notice to the users.

15.3. If there are any disputes between any of the parties (vendors/users) involved as part of the chosen travel plan, final decision will be made by Travelling Wheel and will require your full support in abiding the same.

15.4. Please note that basic contact information of the users will be used by the Travelling Wheel or our vendors in order to notify them with any suitable offers or new services that might interest the users.

16. User's Obligations Account

16.1 The user must be above the legal age to have a binding contract with the site. The user must have a computer and a reliable internet connection to access the site. The site can also be accessed from a mobile phone or tablet through an internet connection.

16.2 Travelling Wheel does not keep track of the emails and messages communicated to the customers. If it is deleted from the customer end, then the site will not be responsible for retaining it back.

16.3 It is the user’s will to get registered to the site. During the registration process, the user shall receive a user ID and password to their email address. Upon which, they can proceed with using the site. No user must access another user’s account without their permission. Unauthorized accessing of other user’s account is an offence. It is the responsibility of the user to intimate the Travelling Wheel regarding any unauthorized usage of their account, if any.

16.4 Also, the user provides Travelling Wheel with the right to disclose the registration information to third parties to a limited extent to carry out the services.

17. Proprietary Rights

Travelling Wheel site might display contents that include pictures, graphics, sounds, video or any mode of advertisements or information is protected under their copyrights, trademark or other property right and policies. Every user must use these materials only with the permission of Travelling Wheel and must not copy or create derivatives of the work without the authorization of Travelling Wheel itself. Failing to do so, might lead to legal liability or prosecution as per law and order.

18. Indeminification.

 User herewith abides to indemnify, hold and defend the Travelling Wheel from and against any and all liabilities. The claims, expenses , losses, damages, and costs levied against or incurred by Travelling Wheel that tend to arise out of, result from, or shall be payable under virtue of, any non-performance of any agreement made or obligation performed by the User in accordance with this Agreement and/or the Terms of Service.

19. Termination of Agreement and Services

19.1 Either User or Travelling Wheel might terminate the Agreement and the corresponding services with or without any notice at all times and shall be resumed immediately.

19.2 The User abides by Travelling Wheel that under few circumstances and without any prior notice, immediate termination of the user's user ID and access to the website and services might be made. The termination shall include breach by the user of this agreement or the Terms of Service, misbehavior against enforcement or government agencies, requests extended by the user, failed to make payment of fees owed by the user with respect to the services as specified.

19.3 Once the user’s account with Travelling is terminated, the user’s right to make use of the website and services shall expire immediately. The data available in their account shall get deleted and cannot be retrieved later.

20. Governing Law
This user agreement and every Terms and Conditions will be governed and formulated in relation to the laws of India without any conflict in the laws, principles and must not cause any disputes arising in relation herewith will be subjected to the jurisdiction under the courts of Faridabad.

EVERY TERM AND CONDITION MENTIONED HERE ARE EXPECTED TO BE READ, UNDERSTOOD AND ACCEPTED BY THE USER.
